Solventum Corp settles class action fee dispute

Solventum agreed to pay $120,000 to resolve a fee dispute tied to a class action that had been dismissed as moot, according to a Delaware Court of Chancery filing.

The agreement closes out the case brought by Eric Gilbert against Solventum Corporation after Gilbert had filed a verified class action complaint on May 10, 2024. Gilbert later moved to dismiss the action as moot on Nov. 13, 2024, while asking the court to retain jurisdiction over attorneys’ fees and expenses.

Under the stipulation, Solventum will make a disclosure in a Form 8-K and then file an affidavit confirming that notice was made. Once that affidavit is filed, the court will close the case on the docket and dismiss it with prejudice as to Gilbert.

The $120,000 payment is described as full satisfaction of the claim for attorneys’ fees and expenses in the action. Solventum must make the payment within 10 business days after the later of the court order or receipt of payment instructions from plaintiff’s counsel.
