Cormedix Therapeutics said the U.S. Court of Appeals for the Federal Circuit upheld a district court ruling that its Minocin for Injection patents are valid and infringed, preserving an injunction that blocks Nexus Pharmaceuticals from launching a generic version before patent expiration.
The appeals court backed findings from a four-day bench trial in 2023 that Nexus’ proposed minocycline product infringes the patents and that Nexus’ invalidity challenge failed. The decision leaves intact the district court’s permanent injunction against marketing the generic product.
Minocin for Injection is Cormedix’s reformulation of intravenous minocycline, an antibiotic used in hospital and acute care settings for serious and drug-resistant infections. The patents are listed in the FDA’s Orange Book.
Cormedix chairman and CEO Joseph Todisco said the ruling “validates the strength” of the company’s intellectual property portfolio and protects the investments made to develop the therapy.
